1. Acceptance of Terms
By accessing and using HomeVisto ("the Platform"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Description of Service
HomeVisto is a technology platform that connects property viewers ("Viewers") with independent service providers ("Scouts") who can visit and document properties on the Viewer's behalf. The Platform facilitates:
- Property visit scheduling and coordination
- Video documentation of properties
- Data collection (internet speed tests, noise levels)
- Secure payment processing
3. Platform Neutrality
HomeVisto is strictly a facilitator. We are not a party to any agreement between Viewers and Scouts. We do not control, endorse, or take responsibility for the conduct of any user, online or offline. Scouts are independent contractors and not employees or agents of HomeVisto.
4. User Accounts
To use certain features of the Platform, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
5. User Conduct
You agree not to:
- Violate any applicable laws or regulations
- Infringe on the rights of others
- Post false, misleading, or fraudulent content
- Harass, threaten, or harm other users
- Attempt to gain unauthorized access to the Platform
- Use the Platform for any illegal purpose
6. Payments and Fees
All payments are processed through our secure payment provider. By using the Platform:
- Viewers agree to pay the bounty amount plus applicable fees
- Scouts receive payment after successful mission completion
- HomeVisto retains a platform fee (30% of the bounty)
- Platform fees are non-refundable except as required by law
7. Data-Point Limitation
You acknowledge that the HomeVisto service is limited to the collection of raw data points (such as video footage, internet speed tests, and decibel readings). The Service does not constitute a professional home inspection, structural analysis, or real estate appraisal. You agree not to rely on the Service for decisions requiring professional licensure.
8. Intellectual Property
The Platform and its content, features, and functionality are owned by HomeVisto and are protected by intellectual property laws. You may not copy, modify, or distribute any part of the Platform without our written consent.
9. Termination
We reserve the right to suspend or terminate your account at any time for violations of these Terms, fraudulent activity, or any other reason at our sole discretion. Upon termination, your right to use the Platform ceases immediately.
10. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMEVISTO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
13. Changes to Terms
We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the new terms. We will notify users of significant changes via email or Platform notification.
