IMPORTANT: Please read this entire document carefully before using HomeVisto services.
User Acknowledgment and Agreement
By using HomeVisto, you acknowledge and accept the following:
1. HomeVisto is a Venue Only
HomeVisto is a technology platform that connects independent users. We do not employ "Scouts," nor do we inspect, verify, or warrant the condition of any property or the accuracy of any report. HomeVisto acts solely as an intermediary facilitating connections between Viewers and Scouts.
2. No Professional Advice
Scouts are not licensed home inspectors, engineers, or real estate agents. Services provided through HomeVisto are for informational "data gathering" purposes only (e.g., video, audio, speed tests) and do not constitute professional structural or investment advice.
You should not rely on HomeVisto services as a substitute for professional inspections or evaluations.
3. Assumption of Risk & Release
You assume all risks associated with the transaction, including but not limited to:
- Financial loss related to leasing or purchasing decisions
- Property damage occurring during missions
- Disputes with other users
- Inaccurate or incomplete information in reports
You expressly release and hold harmless HomeVisto, its officers, directors, employees, and affiliates from any and all liability arising from the acts or omissions of any Scout or third party, whether intentional, negligent, or otherwise.
4. No Refunds for Quality
HomeVisto does not guarantee the quality or completeness of the Scout's work. Any engagement is strictly between the Viewer and the Scout. While we facilitate dispute resolution, we do not warrant any particular outcome or level of service quality.
Indemnification
You agree to indemnify, defend, and hold harmless HomeVisto from and against any and all claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to:
- (i) your use of the Platform;
- (ii) any damage to real property caused during a Mission;
- (iii) any financial loss resulting from a leasing or purchasing decision made based on HomeVisto content;
- (iv) any dispute between you and another user.
Financial Loss Waiver
UNDER NO CIRCUMSTANCES SHALL HOMEVISTO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.
Why These Limitations Exist
These limitations are in place because:
- We provide "Data," not "Advice": HomeVisto explicitly offers data points (video, speed tests) rather than expert opinions. A Scout cannot be held responsible for missing structural issues if they were only engaged to document visible conditions.
- Scouts are Independent: All Scouts operate as independent third parties. HomeVisto does not employ, train, or supervise Scouts in the performance of their services.
- Real Estate Decisions Are Complex: Property decisions should involve professional inspections, legal review, and financial analysis beyond what any platform service can provide.
Governing Law
This Liability Waiver shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
Severability
If any provision of this Liability Waiver is found to be unenforceable, the remaining provisions shall continue in full force and effect.
